sad, but true, VA cops are sticklers about window tint. When i first got my 5, the previous owner had really dark tint. I hadn't even had it a week and i got pulled over. Getting state legal tint was on my "to do" list for later on in the week/weekend. I was southbound on 95 headed to work, state trooper drives past me (about 4 car lengths), then brakes, and slows down so he can get up behind me and pull me over. I guess he thought about it, then decided screw it, pull me over. He pulled out a measuring gun and checked my tint level. Told me to have it changed, bring it to court, and provided a receipt and he'd recommend to the judge to drop it.
OP, sorry the cop didn't have his facts straight, but you had illegal tint so your going to have suck this one up. Usually if you take it to court and show evidence that you are state legal, the judge will drop it. Just show a receipt and pictures of your car w/ legal tint.
