I am not suggesting after-market = illegal. OP says he has an Active Autowerkes exhaust. We all know it is much louder than stock so let's not bury our heads in the sand.
I don't know about Canadian judges, but in the U.S. I seriously doubt the Court is going to need anything other than the cop's testimony on how loud it was to convict. Just the reality of it.
