That's why, "it depends." It depends upon whether BMW decides to investigate whether the engine has been modified. If they do, they can deny it on the basis of an "altered drivetrain."

Since the OP said the car is stock other than the ECU. I doubt BMW would even think it is modified. So chances are they would just fix it.
