The legal action part was to scare him so that he stops jerking me around, but if it comes down to that then I will pursue it.

This is the reason you stick with reputable dealers or just pay a little more for in person service, cause that just cannot be beat sometimes... especially with such a high dollar item. (expensive compared to most consumer watches at least).
