I had some communication with Robert at EAS prior to creating this thread. He acknowledged the issue on their end but with no willingness to make it up.

I understand that issues like these are rare and a freak of nature and I understand that things like this do happen, but in the end it was the response I got that blew me over.

Update... * I have since talked to Tom and we have worked out an agreement and will talk to robert. *
